This report looks at whether the laws and policies in Argentina make it possible for children to access their environmental rights.
Argentina’s Constitution recognises the right of all inhabitants and future generations to a healthy environment. There have been recent developments linking children’s rights and the environment including the use of constitutional rights in environmental cases and the criminal convictions of three individuals guilty of fumigating crops in a field near a school during school hours. Certain Argentinian laws, such as some laws about toxic substances, also refer specifically to children, for example in guidelines regarding chemicals forbidden in children’s toys and other products such as pacifiers. Children are normally able to bring a case to court through a parent or representative, but in limited circumstances children are able to represent themselves if they have the sufficient degree of maturity.
